If your company operates in different countries, there is a fundamental risk that different countries will declare themselves responsible for levying taxes on the same income. The question of the country in which your company is liable for corporation tax essentially depends on the double taxation agreement (DTA) between Belgium and the country in question. The DTA contains regulations on the allocation of the right of taxation and the avoidance of double taxation. An important practical example concerns the question of the existence of a permanent establishment in Belgium. We advise you and ensure that double taxation is avoided.
In addition, a secondment or cross-border employment can have significant tax implications for the employees involved. Double taxation agreements prevent a taxpayer from being subject to a comparable tax twice in two countries for the same taxable item.
